Orders can only be accepted on the understanding that you agree to the following terms and conditions. These do not affect your statutory rights.
1. All goods remain the property of Shoreham Sea Kayaks until paid for in full.
2. Ex-stock items will normally be despatched within one working day via an overnight carrier service (3 days for paddles and kayaks). Alternatively, we may deliver using our own transport, in which case you will be contacted to arrange a day/time which is convenient to you.
3. We keep a selection of the most popular items in stock, but if we do not have the colour/options you require, we can obtain the exact model from the factory, usually next day for clothing and accessories (kayaks usually 2-3 weeks). We will contact you immediately to advise you of any delay and to explain the options available. If we are unable to satisfy your requirements regarding product or delivery time you will be given the option of cancelling your order with a full refund.
4. You are welcome to visit us to inspect the products before purchasing. Please be sure to contact us before travelling to ensure there will be someone here. We also have several demonstration boats available for you to try. Subject to availability, you can change boats as often as you like during the demonstration session to compare different types. The use of our demonstration boats is entirely at your own risk. For your own safety, we may limit the times of demonstration sessions depending on weather and tide.
5. All our products are guaranteed against defects for one year. This guarantee also extends to second-hand and ex-demo products unless otherwise specified. Where a product is covered by an additional manufacturer’s warranty, we also fully honour the terms of this. Naturally, the guarantee excludes normal wear and tear, or damage caused by misuse (eg. If your kayak falls from your roof-rack on the motorway and is hit by a truck, please do not expect a repair or refund! Likewise, we do not guarantee the gel-coat against scratches if you do a seal-landing onto barnacle-covered rocks.) You should consider the warranty of your kayak to be similar to that of your car i.e. it covers manufacturing faults, but not accident damage. Just as with your car, you may wish to cover damage (including third-party damage) and theft by taking out insurance.
6. When you order online we provide secure credit card payment facilities through PayPal. If you prefer, you can phone, fax, or mail your order to us, in which case we can accept payment by cheque. Please make cheques payable to “Shoreham Sea Kayaks” and allow up to 7 days for the cheque to clear.
7. All prices are in Pounds Sterling, and include VAT. A VAT receipt will be provided on request. Delivery is charged extra. The standard delivery charge (£6.50 for accessories or £40 per kayak. Accessories travel free if accompanied by a kayak!) is for UK mainland only. For other destinations, please contact us for a quote. If you are ordering more than one boat, or if you live locally, please call us first because it is sometimes possible to make special arrangements to save on transport costs.
8. Consumer Protection (Distance Selling) regulations 2000. Your rights are protected under these regulations which give you a period of 14 days after delivery of goods, during which you can cancel your order and obtain a refund. You must send your cancellation in writing, but feel free to phone us to discuss the problem first. Goods must be returned in new and unused condition. You will receive your refund within 10 days of us receiving the goods.
9. Kayaking is fun, but it can be dangerous. It is an assumed risk activity and Shoreham Sea Kayaks cannot be held responsible for any loss, damage, injury or death, however caused. You should always follow safety advice as given by the British Canoe Union. In particular, you should wear a buoyancy aid (PFD) at all times and a helmet when appropriate. Never use equipment which is defective or damaged. Avoid paddling alone and never exceed your own abilities. Always carry the correct safety/rescue equipment and know how to use it. We also recommend that you undertake a recognised training course.
